DIVORCE AND FINANCIAL REMEDIES

If you decide to end your marriage and sort out your finances and property issues I am here to help.

The Courts have the power to make Orders in respect of your home, assets and pensions that could have life changing consequences for you.

They can also send you to prison for breaching these Orders.

In making decisions the Court has to weigh upon various issues such as your and your ex's future housing and financial needs, their past and likely future contributions to family life and what assets and debts are 'matrimonial' and 'non matrimonial'.

The law is very complicated in this area because over the years since Parliament last decided what counts in these cases the higher courts have been adding layer and layer of judicial interpretation on top of each other.

I can give you advice on your rights and responsibilities, try and resolve the dispute by negotiated agreement and represent you in court.

Once you have had advice you can do much of the 'groundwork' yourself.

To apply for a Divorce you will need to complete a Form D8

To apply for a Financial Remedies Order you will almost need to complete a Form A or A1.

You will then (almost certainly) need to complete a Form E or E1
